• We are NOT a licensed contractor, professional installer, architect, engineer, or job specifier.

• We do NOT conduct on-site inspections, take job site measurements, specify project requirements, or perform physical application or installation services.

• Site & Environmental Conditions: Ambient air temperature, relative humidity, subfloor moisture levels, slab pH, and structural integrity.

• Surface Preparation: Ensuring all subfloors, existing flooring systems, or application surfaces are clean, dry, sound, and prepped strictly according to the primary manufacturer’s technical guidelines.

• Material & Chemical Compatibility: Performing independent spot-testing and verifying physical, chemical, and bonding compatibility between products purchased from us and any existing surfaces, third-party subfloors, underlayments, finishes, or third-party products.

• Manufacturer Guidelines: Reviewing, understanding, and adhering strictly to the primary manufacturer’s Technical Data Sheets (TDS), Safety Data Sheets (SDS), and official installation or maintenance instructions.

• Codes & Standards: Ensuring full compliance with all local, state, and federal building codes, fire ratings, athletic governing body regulations, and safety standards.

3. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, ALL CONTENT, AND ALL PRODUCTS PURCHASED THROUGH GYM FLOOR RESOURCE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

THIS SECTION STRICTLY LIMITS THE MAXIMUM FINANCIAL DAMAGES YOU MAY RECOVER FROM GYM FLOOR RESOURCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GYM FLOOR RESOURCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Labor expenses, contractor fees, tear-out costs, or re-installation expenses;

• Property damage, floor failure, substrate restoration, or material removal;

• Loss of revenue, business interruption, or lost commercial profits;

• Facility downtime, loss of use, or schedule delay damages;

WHETHER ARISING OUT OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF GYM FLOOR RESOURCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

4.1 Absolute Liability Cap

IN NO EVENT SHALL GYM FLOOR RESOURCE’S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS, DISPUTES, CAUSES OF ACTION, OR LOSSES ARISING OUT OF OR RELATING TO ANY PURCHASE, ADVICE, PRODUCT, OR USE OF THIS WEBSITE EXCEED THE ACTUAL PURCHASE PRICE PAID BY THE CUSTOMER TO GYM FLOOR RESOURCE FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
